By using LeadsResponder ("Service"), you agree to these Terms of Service. Please read them carefully.

Consent to Receive SMS Messages — End Users (Leads)

By submitting your contact information through a LeadsResponder-powered lead form, chat widget, or by verbally consenting during an AI-answered phone call, you expressly consent to receive SMS text messages from the service business you contacted. These messages are sent on their behalf through the LeadsResponder platform and may include both AI-generated responses and direct replies from the business's team. Messages may include follow-up, qualification questions, appointment scheduling, and related business communications.

Message Frequency
Message frequency varies based on your interaction with the business. You may receive multiple messages as part of an ongoing conversation. You are not required to consent to receive SMS messages as a condition of purchasing any goods or services.

Opt-Out
Reply STOP at any time to stop receiving SMS messages from that business. After opting out, you will receive one final confirmation message and no further messages will be sent.

Reply HELP at any time for assistance, or contact the business directly. You may also reach LeadsResponder support at support@leadsresponder.com.

Message and Data Rates
Msg & data rates may apply. Check with your mobile carrier for details on your plan.

Carriers
Supported carriers include AT&T, T-Mobile, Verizon, Sprint, and most major US carriers. Carrier is not liable for delayed or undelivered messages.

SMS Compliance — Business Owners (Platform Users)

As a LeadsResponder customer, you are the sender of record for all SMS messages delivered to your leads. By using this platform, you agree to comply with all applicable laws and regulations governing SMS communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable CTIA guidelines.

SMS Registration — A2P 10DLC Requirement

LeadsResponder operates as an Independent Software Vendor (ISV) and multi-tenant SMS platform. To comply with US carrier requirements for Application-to-Person (A2P) 10-digit long code (10DLC) messaging, each business using this platform must be individually registered as a Brand and Campaign through The Campaign Registry (TCR). By signing up, you authorize LeadsResponder to submit your business information — including your legal business name, EIN/Tax ID, business address, and website — to TCR and to our SMS delivery provider on your behalf for the purpose of SMS registration.

You acknowledge that SMS message delivery is contingent on successful A2P Brand and Campaign registration. LeadsResponder is not liable for message delivery failures resulting from registration delays, rejections, or carrier filtering.

Your Obligations

• You must obtain express consent from leads before SMS messages are sent on your behalf. Consent is obtained when a lead (a) submits a form or widget that includes proper SMS opt-in disclosure language, or (b) verbally agrees to receive a text follow-up during an AI-answered inbound phone call. Consent is documented automatically by the LeadsResponder platform and stored per lead.
• Your lead capture forms and widgets must include a disclosure such as: "By submitting this form, you agree to receive SMS messages from [Business Name] regarding your inquiry. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out."
• You must provide accurate business registration information (legal name, EIN/Tax ID, address, website) during onboarding. Providing false or incomplete information may result in SMS service suspension.
• You must honor all STOP requests promptly. LeadsResponder automatically suppresses opted-out numbers at the platform level.
• You may not use LeadsResponder to send unsolicited, spam, or deceptive messages.
• You are responsible for ensuring your use of this platform complies with all applicable laws and carrier regulations, including the TCPA, CAN-SPAM Act, and CTIA Messaging Principles and Best Practices.

Recommended Consent Language for Your Forms
We recommend displaying the following disclosure on any form or widget where leads enter their phone number:

"By providing your phone number and submitting this form, you consent to receive text messages from [Your Business Name] about your inquiry. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out or HELP for help. View our Privacy Policy."

LeadsResponder is not liable for your failure to obtain proper consent or to comply with applicable SMS regulations. You indemnify and hold harmless LeadsResponder from any claims, fines, or penalties arising from your non-compliance.

Use of Service

LeadsResponder provides AI-powered lead response tools for service businesses. You may use the Service only for lawful business purposes. You agree not to:

• Use the Service to send spam or unsolicited messages
• Misrepresent your business or services to leads
• Use the Service for any illegal purpose
• Attempt to reverse engineer or copy the platform

Account Responsibilities

You are responsible for maintaining the security of your account and all activity that occurs under it. You must notify us immediately of any unauthorized access at support@leadsresponder.com.

Payment Terms

The Service is available in three tiers billed monthly: Starter ($79/month), Pro ($149/month), and Growth ($229/month). Promotional pricing may be available. Payments are processed by Stripe. Your subscription will automatically renew each month unless cancelled. No refunds are provided for partial months.

Cancellation

You may cancel your subscription at any time directly from your account Settings. Your account will remain active until the end of the current billing period. No action is required beyond cancelling in Settings — you will not be charged again after cancellation.

AI-Generated Content

Responses sent to your leads are generated by AI and are provided as-is. You are responsible for reviewing the nature of your business information to ensure appropriate responses. We are not liable for the content of AI-generated messages.

Limitation of Liability

LeadsResponder is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the last 30 days.

Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We are not liable for any losses resulting from service downtime or interruptions.

Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of significant changes by email.
